INITIAL PAYMENT: Ownership and cask filling require full payment in advance.

PRICE: The pricing structure is contingent on the type of cask, as specified in our order form. This price covers the cost of the spirit, along with warehousing and insurance for a ten-year period. Additional storage and insurance can be procured in one-year increments at the prevailing rates. The price does not include the wooden cask, which remains the property of the distillery. Furthermore, the price encompasses certain benefits, including an ANTLER Distribution Distillery Cask Owner’s Certificate (for up to two individuals when sharing, or a designated club or group, at ANTLER Distribution’s discretion). Distillery visits can be arranged by appointment, subject to the distillery’s operational requirements.

CHANGE OF ADDRESS: Notifications of any address or contact detail changes must be promptly communicated to ANTLER Distribution via email. Confirmation of the change will be sent via email, and the change will be considered official only upon receipt of confirmation by ANTLER Distribution.

NON-PAYMENT OR LOSS OF CONTACT: In cases where we are unable to contact you within six months after ten years from the Cask’s filling date or if any outstanding payment is not received as scheduled, we reserve the right to sell the Cask and its contents. We will retain the proceeds after deducting sales and warehousing costs.

THIRD PARTY RIGHTS, GOVERNING LAW, AND JURISDICTION: Under this sales contract, your rights cannot be transferred or assigned to a third party without written consent from ANTLER Distribution. This contract is governed by English law, and both parties accept the exclusive jurisdiction of the English Courts for any related matters. In the event of any discrepancies between translations of this contract and the English version, the English version prevails.

INTELLECTUAL PROPERTY RIGHTS: The expressions “ANTLER Distribution,” “ANTLER Distribution Whisky,” “ANTLER Distribution Single Malt Scotch Whisky,” or any derivatives involving the name “ANTLER Distribution” and associated logos and devices are the intellectual property of ANTLER Distribution Distillery Limited. Copyright, designs, and all related rights are owned and reserved by ANTLER Distribution Limited. Unauthorized use of the expressions “ANTLER Distribution Whisky,” “ANTLER Distribution Single Malt Scotch Whisky,” or derivatives involving the name “ANTLER Distribution,” along with associated logos and designs, is strictly prohibited. Permission to use the expression “ANTLER Distribution” (typically styled ‘ANTLER and derivatives using ANTLER or ANTLER distribution from or produced at its connected distilleries’) may be granted, but the associated logos and designs are excluded from such permission.

LIMITATION OF LIABILITY: Except for liabilities that cannot legally be limited, and liability arising from deliberate fault, neither party shall be liable for loss of profit, sales, business, agreements, contracts, anticipated savings, data, information, damage to goodwill, or indirect or consequential damage. The distillery’s total liability to the Cask Owner shall not exceed the amount paid by the Cask Owner and/or the Purchaser (ANTLER Distribution) on behalf of the Cask Owner under the relevant Order.

FORCE MAJEURE: A “Force Majeure Event” encompasses circumstances beyond a party’s control. In the event that the distillery is unable to fulfil its obligations due to a Force Majeure Event, it shall not be considered in breach of this Agreement. The time for performance of obligations shall be extended accordingly. Notification of a Force Majeure Event shall be provided within 14 days of its onset, detailing its impact and expected duration. The parties shall cooperate to mitigate the effects of the Force Majeure Event on performance.
